DOJ's RealPage Sweep Is Nearly Done. Now What
Pinnacle has settled with the Justice Department over its use of RealPage's rent-pricing software, joining nearly every other major defendant in the case. One holdout remains, but at this point that's a rounding error, not a defense strategy.
This case has mostly lived on the revenue management side of the org chart, which is why marketing directors have felt free to ignore it. That's a mistake. If your pricing tool is feeding "market-informed" rent recommendations into your ILS listings, your website, or your ad copy, you're not adjacent to this story. You're distributing the output of the thing the DOJ just spent two years calling collusion.
The fix isn't legal, it's operational, and it's yours to push on. Ask revenue management directly whether pricing recommendations are still coming from shared or pooled data, and get an answer you can repeat to a regional without flinching. If the software's still doing what got everyone else sued, the fact that your unit still hasn't settled isn't reassurance. It's a queue.
None of this is about whether the algorithm was ever right about rent. It's about whether "the software said so" is still a sentence you can say out loud in a deposition. Right now, for almost everyone who's tried, the answer has been no.
